General Terms of Sale
The present conditions of sale are concluded, in one hand, by “ORDI-SPARE”, a division of EURINCO Ltd whose head office is located as follow :
6 Avenue Maréchal Juin - 69720 SAINT LAURENT DE MURE, registered with the trade register under the number 350 893 467 00026 and, in addition by any natural person or moral wishing to proceed with a purchase via website “ORDI-SPARE”, hereafter called “the purchaser”.
Object
The present conditions of sale aim at defining the contractual relations between ORDI-SPARE and the purchaser and the conditions applicable to any purchase carried out by the means of the site of E-commerce ORDI-SPARE; whether the purchaser is professional or consumer. These conditions of sale will prevail on all other general terms or particular not expressly approved by ORDI SPARE.
ORDI-SPARE is booked to be able to modify its conditions of sale constantly. In this case, the applicable conditions will be those in force at the date of the order by the purchaser.
Characteristics of the goods proposed
The offered products are those of the catalogue published on site ORDI-SPARE, within the limit of stocks available. Each product is accompanied by a description and, for certain products, a data sheet in downloadable “pdf”.
The photographs of the website catalogue are most faithful possible but cannot ensure a perfect similarity with the product offered, in particular to the colors.
Prices and Rates
The prices appearing in the catalogue are prices HT in euros, without including taxes . The VAT rate which will be applied is the rate in force at the day of the order, in accordance with the legislation in force.
Any change of the rate will be reflected on the price of the products. ORDI-SPARE reserves the right to modify its prices constantly, however being understood that the price appearing in the catalogue the day of the order will be the price applied.
The prices indicated for the whole of the products, unit and/or batches include the expenses of treatment of orders and packing, except the transport costs and of delivery.
Orders
The buyer who wishes to buy a product must :
- Fill out a registration form on which he will provide full contact information such as name and address or remind his customer registration number.
- Fill out his order on line by checking out all of the products he is ordering.
- Review his order before validating.
- Pay his order in accordance with the conditions specified.
- Confirm his order and his settlement. The order confirmation shall act as acceptance of the present conditions of sale and the recognition of having read and understood and a disclaimer with regards to his own purchasing terms or other conditions. The information provided by the buyer and the registered confirmation will be worth proof of the transaction.
The confirmation is considered as a signature and an acceptance of the agreement to the business transaction made. The seller “ORDI-SPARE” will send an e-mail confirmation that the order is well recorded.
Reshipments
Our products benefit from advanced technology and were imported under licence distribution. They can not be reshipped without preliminary agreement of the administration of the concerned countries and in compliance with the legislation.
Withdrawal
Buyers, either persons or legal entities, have a time of 3 days retractation frank as from the delivery date of their order to ship back the product to “ORDI-SPARE” for exchange or refund without penalty, with the exception of the expenses of return, under the condition that the material underwent no modification or degradation and must necessarily be returned in its original packing.
Terms of payment
Payments are due with order. Payments will be done by credit card and will be realized by means of secured system CM/CIC, tool of online payment of the CREDIT MUTUEL CIC bank, which uses the SSL (Secure Socket Layer) secured protocol in such way that the information transmitted will be encrypted and no third-party will be able to intercept this during transmission through the network.
The total amount of the buyer’s order will be debited on the buyer’s account when order validation. He will receive a paper invoice on which the VAT will be highlighted.
Deliveries
Deliveries are made on working days, within a maximum lead time of 72 hours upon receipt of the settlement at the address provided on the order form.
All delivery times provided by us are only given for information purposes, if these exceed 30 days as from the date of order, the sale contract can be cancelled and the buyer gets to be paid off
Complaints
Buyer must check his order when he received it to compare with what he ordered.
Any claims will have to be carried out within 48 hours at the latest following the delivery date by registered letter with acknowledgement receipt. No return will be accepted without prior written agreement by ORDISPARE and any RMA (Return Material Authorisation) number provided by ORDISPARE.
In the event of damage during transport, we ask you to refuse the delivery of a parcel with signs of visible damage and or deterioration (damaged box, broken box, box unsealed and re-sellotaped).
It is up to the buyer to refuse or to put any reserve at the time of the reception of the goods and to bring any justification on the reality of the anomalies and noted degradations. These reservations will be reported to the delivery order of the carrier, the day of the delivery, in the presence of the driver. These must be précised and quantified.
Moreover, the claim must be also confirmed by registered letter with acknowledgement of delivery to the carrier company within 3 days following date of delivery.
Warranty
All the products sold by ORDISPARE are used part and covered with a 6 months warranty, a legal guarantee as stipulated in articles 1641 and following of the French Civil Code. In the event of non conformity of a sold item, the item can be returned for repair, replace or refund.
Any claims, any request for replacement or refund must be done by regular mail at the below address :

within 3 days following delivery.
Warranty exclusions :
The warranty does not apply in the following cases without this list to be exhaustive :
- normal wear and tear,
- inexpert use,
- defect, deterioration or issues coming from storage orinexpert use of the goods or other inappropriate handling.
We recommend that only experienced user’s with a suitable workshop perform installation of our items
Liability
ORDISPARE, in the process of on-line sale, is only bound by an obligation of means. His liability can not be commited for any damage resulting from using the internet network such as data loss, hacking, virus, break of the service or other unintended issues.
Intellectual Property
All the elements of the site ORDI-SPARE are and remain the intellectual and exclusive property of ORDI-SPARE and EURINCO. Nobody is allowed to reproduce, use, rebroadcast or use for any reason whatsoever, even partially, elements of the website, whether software, visual or audio. Any simple or hypertext link is strictly forbidden without express written agreement from ORDI-SPARE and EURINCO.
Personal Data
ORDI-SPARE collects no personal data without his customer’s knowledge while browsing their site.
The www.ordi-spare.com site collects data concerning the buyer. They are necessary and only intended for the processing of the buyer’s order as well as for the management of the business connections between ORDI-SPARE and the buyer.
The automated processing of information, including the management of user’s e-mail address has been declared to the CNIL (French Data Protection Authority) under the number 1796472 v O on the 24/09/2014.
The personal data of the customers of ORDI-SPARE are protected on-line and off-line. Banking transactions are made through secured pages under the 3D protocol Secure and SSL.

Archives and Proof
ORDI-SPARE archives order forms and reliable and permanent support so as to constitute a mean of evidence as per provisions of section 1348 of the French Civil Code. ORDI-SPARE computerised records shall be deemed by the parties to be proof of the communications, orders, payments and transactions occurring between them.
Dispute settlement
The present on-line general terms of sale are submitted to the French Law. The parties shall attempt to settle amicably any disputes that may arise between them concerning the interpretation and/or the execution of the order and / or its termination or these general conditions of sales. If those parties can not agree, the settlement of the dispute shall be submitted to the Commercial Court of Lyon, despite multiple defendants or collateral, ruling if necessary in emergency proceeding, excluding any other jurisdiction.
